TERMS OF SERVICE

THESE TERMS OF SERVICE CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND ALPHASQUARED TECHNOLOGIES INC. ("ALPHASQUARED TECHNOLOGIES") STATING THE TERMS THAT GOVERN YOUR USE OF THE SAFETY QUIZZ SITE (SAFETYQUIZZ.COM) AND THE PRODUCTS AND SERVICES OFFERED THROUGH IT ("SAFETY QUIZZ").

BY USING THE SERVICE IN ANY WAY OR ACCEPTING ANY RELATED SERVICES FROM ALPHASQUARED TECHNOLOGIES, YOU AGREE THAT YOU:

IF YOU DO NOT AGREE TO THESE TERMS OF SERVICE, DO NOT USE SAFETY QUIZZ. YOU MUST ACCEPT AND ABIDE BY THESE TERMS OF SERVICE AS PRESENTED TO YOU: CHANGES, ADDITIONS, OR DELETIONS ARE NOT ACCEPTABLE, AND ALPHASQUARED TECHNOLOGIES MAY REFUSE ACCESS TO SAFETY QUIZZ FOR NONCOMPLIANCE WITH ANY PART OF THESE TERMS OF SERVICE.

The terms "our", "us", "we" refer to AlphaSquared Technologies.

Access

Access to Safety Quizz is provided solely as an accommodation and at AlphaSquared Technologies' sole discretion, and is available to any unauthorized internet user (except some particular applications - see below). Your access to particular Safety Quizz services may be further limited by the Safety Quizz administrative user(-s).

System Requirements

Use of Safety Quizz requires compatible hardware (fees may apply), Internet access (fees may apply), and certain software (fees may apply), and may require obtaining updates or upgrades from time to time. Because use of Safety Quizz involves hardware, software, and Internet access, your ability to use Safety Quizz may be affected by the performance of these factors. High speed Internet access is strongly recommended. You acknowledge and agree that such system requirements, which may be changed from time to time, are your responsibility.

Agreement

Your use of Safety Quizz is, if applicable, subject to the terms of any Agreement, including, without limitation, its confidentiality provisions. In the event of any conflict between these Terms of Service or any information provided on Safety Quizz, on the one hand, and any applicable Agreement, on the other hand, the terms of such Agreement shall govern.

Your Information

You agree to provide accurate, current, and complete information required to register with Safety Quizz and at other points as may be required in the course of using Safety Quizz ("User Data"). You hereby confirm that any User Data you already have provided to AlphaSquared Technologies (including, without limitation, in the Alphasquared Newsletter process or through prior use of Safety Quizz) has been accurate, current and complete. You further agree to maintain and update your User Data as required to keep it accurate, current, and complete.

Particular Safety Quizz Services

Free Online Quizzes

You agree to use free online quizzes at safetyquizz.com. These quizzes are for general information only. Nothing at Safety Quizz is intended to provide legal advice or to be relied on as binding in any dispute, claim, action, demand or proceeding.

FSC Fast Track Prep

You agree to use paid online quizzes to quickly (for most users it takes under 1 hour) prepare to your FSC written test. The application allows you to focus on just bare minumum and on the most probable questions. Nothing at Safety Quizz and FSC Fast Track Prep is intended to provide legal advice or to be relied on as binding in any dispute, claim, action, demand or proceeding.

FSC Fast Track Prep can be used under the following conditions:

  1. You have to be authenticated and authorized. Unauthorized access is not allowed.
  2. Your membership is a subject to a fee. Please refer to FSC Fast Track Prep Login page for the exact fee value.
  3. AlphaSquared cannot guarantee the speed of your preparation (however, for most of our users it takes under 1 hour).
  4. Your account will be terminated in 15 days (Don't worry, you have plenty of time to pass your FSC written test).
  5. In some cases you may request a refund under the following conditions:
    1. Your membership is refund-eligible (i.e. you have registered during the specific time slot when such setting was turned on by the site's administration; that will be indicated at the Login screen);
    2. You have to provide 2 questions (with answers) which you met at your FSC written test and which are not included into the FSC Fast Track Prep.
    3. Refund request must be sent via FSC Fast Track Prep application ONLY;
    4. Refund request may be issued ONLY by an active user (valid, non-expired account who paid the fee) with verified email;
    5. Your refund request will be reviewed by AlphaSquared. Be ready to provide more details if asked;
    6. AlphaSquared makes the final decision: your refund request is either approved or declined. This decision is final and cannot be disputed.
  6. You cannot disclose or publish questions from FSC Fast Track Prep. See also "Intellectual Property" below.
  7. You are bound by all other terms of this agreement described above and below.

Articles

Articles at Safety Quizz are for general information only. Nothing at Safety Quizz is intended to provide legal advice or to be relied on as binding in any dispute, claim, action, demand or proceeding.

Email Newsletter (if applicable)

If you agree, you may receive our monthly newsletter (AlphaSquared Newsletter) regarding but not limited to: news, brand-new apps, quizzes, crowdfunding campaigns; advice, techniques, articles about your implied realm of interest. E.g. you subscribe to the newsletter at firearms related quizzes, thus AlphaSquared Newsletter for you may contain advice, techniques, articles about firearms.

Intellectual Property

Acknowledgement of Ownership

You agree that Safety Quizz contains proprietary information and material that is owned by AlphaSquared Technologies and/or its licensors, data and service providers, and is protected by applicable intellectual property and other laws, including but not limited to copyright, and that you will not use such proprietary information or materials in any way whatsoever except for use of Safety Quizz in compliance with these Terms of Service. No portion of Safety Quizz may be reproduced in any form or by any means.

Copyrights

All copyrights in and to Safety Quizz are owned by AlphaSquared Technologies and/or its licensors, data and service providers.

Trademarks

Safety Quizz, the Safety Quizz logo, SafetyQuizz.com website and other AlphaSquared Technologies trademarks, service marks, graphics, and logos used in connection with Safety Quizz are trademarks or registered trademarks of AlphaSquared Technologies Inc. in the U.S., Canada and/or other countries. You are granted no right or license with respect to any of the aforesaid trademarks and any use of such trademarks.

Disclaimer of Warranties. Liability Limitations

ALPHASQUARED TECHNOLOGIES DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF SAFETY QUIZZ WILL BE UNINTERRUPTED OR ERROR-FREE, AND YOU AGREE THAT FROM TIME TO TIME ALPHASQUARED TECHNOLOGIES MAY REMOVE SAFETY QUIZZ (OR PARTICULAR PRODUCTS OR SERVICES THEREIN) FOR INDEFINITE PERIODS OF TIME, OR CEASE TO OFFER SAFETY QUIZZ IN ITS ENTIRETY, AT ANY TIME, WITHOUT NOTICE TO YOU. YOU EXPRESSLY AGREE THAT YOUR USE OF, OR INABILITY TO USE, SAFETY QUIZZ IS AT YOUR SOLE RISK. SAFETY QUIZZ AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH SAFETY QUIZZ ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT. IN NO CASE SHALL ALPHASQUARED TECHNOLOGIES, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF SAFETY QUIZZ OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF SAFETY QUIZZ, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY PRODUCT OR SERVICE, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY PRODUCT OR SERVICE, POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA SAFETY QUIZZ, EVEN IF ADVISED OF THEIR POSSIBILITY. ALPHASQUARED TECHNOLOGIES DOES NOT REPRESENT OR GUARANTEE THAT SAFETY QUIZZ WILL BE FREE FROM LOSS, CORRUPTION, ATTACK, VIRUSES, INTERFERENCE, HACKING, OR OTHER SECURITY INTRUSION, AND ALPHASQUARED TECHNOLOGIES DISCLAIMS ANY LIABILITY RELATING THERETO.

Indemnity

BY USING THE SAFETY QUIZZ SERVICE, YOU AGREE, TO THE EXTENT PERMITTED BY LAW, TO INDEMNIFY AND HOLD ALPHASQUARED TECHNOLOGIES, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND LICENSORS HARMLESS WITH RESPECT TO ANY CLAIMS ARISING OUT OF YOUR BREACH OF THESE TERMS OF SERVICE, ANY REPRESENTATIONS OR WARRANTIES MADE BY YOU HEREIN, OR YOUR OTHER IMPROPER, UNAUTHORIZED OR UNLAWFUL USE OF SAFETY QUIZZ.

AlphaSquared Technologies may send you notice with respect to Safety Quizz by sending an email message to the email address listed in your contact information. To receive email messages from AlphaSquared Technologies you must explicitly subscribe to our free newsletter.

Governing Law

You expressly agree that this Agreement is governed by and construed in accordance with the laws of the Province Of Ontario, Canada, without giving effect to any choice-of-law or conflict-of-law provision or rule (whether of the Province Of Ontario or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than that of the Province Of Ontario. You hereby consent to, and agree to bring any and all claims in, the exclusive jurisdiction of the provincial and federal courts located in Oakville, Ontario, Canada, for any action or proceeding arising under or relating to this Agreement, the Service or the use of, or reliance on this Service, whether based in contract or tort or otherwise.
